General Terms and Conditions of Sale
INTRODUCTION:
The commercial transport of passengers is a regulated activity. Only authorised vehicles, chauffeur-driven passenger vehicles and taxis may perform this service. All orders placed imply the customer’s acceptance of the general terms and conditions of sale (GTCS) provided below. Alpway undertakes to respect them in their entirety and to make every effort to guarantee outstanding service for its customers.
- PRICES
Any quotation drawn up in advance is only valid for thirty days from the date of issue. The price applies to direct, non-stop trips from the point of pick-up to the point of arrival. Prices include tax (10% VAT), except in the case of provision of a vehicle (20% VAT) and are always provided in euros. Prices include the transport of passengers, the vehicle, the driver, insurance for passengers, and services provided in the vehicle (drinks, sweets, newspapers, etc.).
- BOOKING
All services must be booked by contacting Alpway by phone, SMS, email, or directly on the website. Bookings must be made no later than 60 minutes before the start of the said service and will only be effective if the driver can honour the booking with regard to the geographical location. The booking must be made by the customer or by a duly authorized representative. All bookings must include the following:
- name or legal name of the company
- the customer’s name and phone number
- Pick-up date, time and place
- CANCELLATIONS
All cancellations must be received within 24 hours of the said service. It is your duty to notify Alpway in the event of any problems as soon as possible.
- LIABILITY
Any damage caused by the customer to the inside or outside of the vehicle will be at their own expense (door opening), unless it can be proven that it was caused by a third party. Smoking in the vehicle is strictly prohibited. Seat belts must be worn in the front and rear of the vehicle. Customers who violate this law may face fines which they will be required to pay. Customers may under no circumstances ask the driver to exceed the permitted speed limit or ask the driver to commit traffic violations. Drivers have a duty to observe and enforce all applicable laws.
Alpway reserves the right to interrupt the service underway if the customer should commit an offence. Examples include the use of narcotics, alcohol consumption or inappropriate remarks directed at the driver or at any person inside or outside the vehicle, and if the customer should put the driver or anyone else in danger. Clean-up fee: €100
- DURATION AND LOCATION WHERE SERVICES ARE TO BE DELIVERED
The service starts on the day and at the time agreed to by the customer and Alpway. It starts at the location provided by the customer and ends once the destination is reached.
- LAST-MINUTE CHANGES
Additional charges will apply if the customer should make any changes while the service is being performed and only if the initial distance is extended.
- PAYMENT
Our services are payable at the time of booking or when they are picked up, except for “professional customers”. Professional customers must pay the invoice within 30 days of the invoice date. Accepted payment methods are limited to cash and credit card. Customers will receive an invoice for payment of €25 or more. Customers may receive an invoice for payments below this amount by request.
- LIMITATION OF LIABILITY
Alpway shall not be held liable for any delays due to circumstances beyond its control (closed roads, detours, traffic jams, weather conditions, demonstrations, immobilization of the vehicle for various reasons, etc.). If this should occur, we will make every effort to find another driver for the customer. Customers shall take full and sole responsibility for their luggage and any other belongings.
Alpway acknowledges its obligation to take the necessary measures to ensure passengers’ safety and reserves the right to refuse services to any individual who might compromise the safety and good condition of the vehicle.
The transport of animals is usually prohibited, unless Alpway is informed in advance and grants its approval.
Alpway shall not be held liable for the loss or misplacement of any items whatsoever that may be left in the vehicle after completion of the service and is therefore fully released from any liability in this respect. Any forgotten items found in the vehicle will be returned to the passenger as soon as possible.
- INSURANCE
Alpway’s liability is limited to the clauses of its insurance contract, its professional insurance “for commercial passenger transport”, which fully covers passengers transported in a saloon car in the context of a commercial activity in the event of accidents resulting in personal injury, in accordance with the French regulations in force: Article L3120.4 of the Transport Code, pursuant to the Order of 18 April 1966 on the professional conditions for chauffeur-driven passenger vehicles.
- PERSONAL DATA
Alpway undertakes to respect the privacy of its customers.The information collected from customers will not, under any circumstances, be sent to any third parties.
- SAFETY
The vehicle and driver will be in possession of all the documents needed to successfully perform the service. There is no limit regarding the number of bags, but they must not exceed the vehicle’s cargo capacity and each piece of luggage must not exceed 20kg per passenger. Luggage must not present any risk of damage to the vehicle. Failure to comply with these conditions will result in an additional charge.
- DISPUTES
Claims will be only be considered within 120 hours of the service provided. After this point, the Chambéry Commercial Court shall have sole jurisdiction.
